Short-Term Guest Rental Agreement

0. Parties. This Agreement is between SWASAM ECOMMERCE LLC ("Host"), the entity identified with Arbor Vista Retreat in the current property tax records, and the guest who submits or accepts a reservation ("Guest"). References to "we," "us," or "Arbor Vista Retreat" refer to Host.

1. 1. Agreement and reservation. These house rules supplement the terms accepted through the applicable booking channel. Booking-channel terms govern if there is a conflict.
2. 2. Payment and cancellation. Current payment, cancellation, refund, and minimum-stay terms are displayed by Airbnb before checkout. This website does not collect payment or signatures.
3. 2A. Taxes. For any future direct booking, Guest is responsible for all applicable Tennessee sales taxes and local occupancy taxes. Host will collect and remit those taxes as required by law. For marketplace bookings, tax collection and remittance are governed by the applicable marketplace and law.
4. 3. Occupancy. The standard sleeping setup accommodates six guests. Seven or eight guests require prior written host approval and confirmed sofa-bed availability. Occupancy may not exceed the approved guest count.
5. 4. Property use. The cabin may be used only for lawful residential vacation purposes. Parties, events, and commercial activity are prohibited.
6. 5. No smoking or vaping. Smoking or vaping is prohibited inside the cabin and near entrances.
7. 6. Pets. Arbor Vista Retreat does not permit pets of any kind, including but not limited to dogs, cats, and other domestic or exotic animals. Guests who bring an unauthorized pet may be asked to remove the animal or vacate the property, and may be charged a pet fee and/or cleaning fee as permitted by the applicable reservation terms.

   Service Animals: Service animals that qualify under applicable law are welcome and are not subject to pet fees. Under the ADA, a service animal is generally a dog individually trained to do work or perform tasks for a person with a disability. When the work or task is not obvious, Host may ask only the two questions permitted under the ADA: (1) is the animal required because of a disability, and (2) what work or task has the animal been trained to perform. Host will not require certification or other documentation, require the animal to demonstrate its task, or ask about the nature of the person's disability. Emotional support, comfort, or companion animals are not service animals under the ADA; any rights that may apply under other federal, state, or local law remain governed by that law. Guests remain responsible for damage caused by a service animal to the same extent they would be responsible for damage caused by any other member of their party.

8. 7. Check-in and checkout. Check-in begins at 4:00 PM. Checkout is by 10:00 AM.
9. 8. Condition and reporting. Cleanliness, maintenance, or damage concerns should be reported promptly through the active booking channel.
10. 9. Damage and extraordinary cleaning. Guests are responsible for damage, missing items, and extraordinary cleaning caused by their group, visitors, or invitees, subject to the applicable reservation terms.
11. 10. House and resort rules. Guests must follow Arbor Vista Retreat and Shagbark Resort rules, including gate-registration requirements.
12. 11. Gate registration and data sharing. For a confirmed reservation, the primary driver's name, email, mobile number, and vehicle information may be shared with Shagbark Resort solely for gate registration and access.
13. 12. Wildlife and amenities. Guests should use the hot tub, pool, decks, fireplaces, and other amenities responsibly and follow posted safety instructions. Food and scented items should be secured to reduce bear activity.
14. 12A. Assumption of risk. Guest acknowledges that use of the hot tub, decks, fireplaces, grills, trails, and surrounding wooded property carries inherent risks, including but not limited to slipping, burns, falls, and encounters with wildlife, including bears and other animals native to the area. Guest voluntarily assumes such inherent risks for themselves and their group and agrees to supervise children and other members of their party accordingly.
15. 12B. Limitation of liability. To the fullest extent permitted by Tennessee law, Host is not liable for injury, loss, or damage arising from Guest's use of the property or its amenities, except to the extent liability cannot lawfully be limited or waived, including as applicable for gross negligence or willful misconduct. Host does not guarantee uninterrupted utilities, internet, weather conditions, road access, or third-party resort services and is not liable for losses arising from such interruptions except as otherwise required by law.
16. 12C. Indemnification. To the fullest extent permitted by law, Guest agrees to indemnify and hold harmless Host, its members, managers, and agents from claims, damages, or expenses, including reasonable attorney's fees, arising from Guest's or Guest's invitees' use of the property, violation of this Agreement, or violation of law, except to the extent caused by conduct for which indemnification cannot lawfully be required.
17. 13. Personal property. Guests are responsible for their vehicles and personal belongings except as required by law.
18. 14. Utilities and interruptions. Host will make reasonable efforts to address service interruptions. The limitations and exclusions regarding utilities, internet, weather, roads, and third-party resort services are stated in Section 12B.
19. 14A. Governing law and venue. This Agreement is governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. To the extent a contractual forum-selection clause is enforceable, any state-court dispute arising from this Agreement or Guest's stay shall be brought in a court of competent jurisdiction in Sevier County, Tennessee; if federal subject-matter jurisdiction exists, venue shall lie in the United States District Court for the Eastern District of Tennessee, Knoxville Division.
20. 14B. Severability. If any provision of this Agreement is found unenforceable, the remaining provisions remain in full force and effect.
21. 15. Electronic acceptance. When direct booking launches, the complete agreement, version, consent language, signature process, and guest copy will be presented before submission.
